Terms of use

Agreement

These terms are an agreement between you and Nicholas Horton, an individual based in the State of Maryland, United States, operating Agave & Note in his personal capacity ("we", "us"). By creating an account or using the app, you accept them.

You must be at least 18 years old and of legal drinking age where you live to use Agave & Note. Where the drinking age is higher than 18, that higher age is the one that applies to you.

Drinking responsibly

Agave & Note is a journal. It is for writing down what you drank and what you thought of it, not for drinking more of it. Nothing in the app - not the achievements, not the streaks, not Tahona - is designed to push you toward another pour, and we will not add anything that does.

Drink responsibly, never drive after drinking, and if you are worried about your drinking, talk to a doctor rather than an app. Tahona is not qualified to help with that and will say so.

Your account

Keep your credentials to yourself; you are responsible for what happens on your account. Give us accurate information, and email info@agaveandnote.com if you think your account has been compromised.

Your content

The pours, notes, photos, Shelf and hunt list you add remain yours. You grant us the limited right to store and process them only to run the app for you - storing your photos, syncing your journal to your other device, and sending journal context to Tahona when you ask it a question.

Do not upload anything unlawful or anything you do not have the right to use.

You can export your journal to CSV for free, whether or not you subscribe. We are not interested in holding your notes hostage.

Tahona, the AI guide

Tahona's answers are generated by an AI model. They are suggestions, not expert advice, and they can be confidently wrong about strengths, agave species, release years, availability and anything else. Check anything that matters.

Tahona will not give medical advice and will not help you drink more. Ask it about what is on your shelf and it is in its element; ask it about your health and it will tell you to ask a doctor.

With Pro, Tahona can search the web to answer questions about specific bottles, and will show the pages it used. Those pages belong to other people: we do not control or endorse them, and a page being cited does not make it correct. Links open outside the app under those sites' own terms.

AI features have fair-use limits per account, including how often Tahona may search the web. We may adjust those limits to keep the service reliable and affordable, and the app shows you where you stand before you spend a request.

Bottle information

The built-in catalog of producers and expressions, and anything a label scan pulls off a photo, is provided for convenience and can be wrong or out of date. Always check the bottle in front of you. A scan result is always shown to you for review before it is saved; it never saves itself.

Acceptable use

Do not misuse the app: no attempting to reach other users' data, no probing or disrupting the service, no reverse engineering, no automated scraping, and no using the AI features to produce unlawful or harmful content.

Free and Pro

The journal is free and stays free. So does The Shelf - there is no cap on how many bottles you can track - and so is exporting your journal to CSV.

The free tier includes 3 label scans for the lifetime of the account and 5 Tahona conversations per calendar month. Pro removes both limits and adds web search, Tonight's Pour, flight building, Shelf insights and the richer export. Free users see labelled samples of the Pro tools rather than a hidden answer behind a wall.

There are no ads in Agave & Note, on any tier, and there never will be.

Subscriptions

Pro is sold as a monthly or an annual subscription, billed through your Apple Account or Google Play account. There is no lifetime or one-time unlock: Pro's value is metered AI usage that costs us money every month, and we would rather charge a fair recurring price than sell a permanent unlock we cannot afford to honour.

Subscriptions renew automatically unless you cancel at least 24 hours before the current period ends. Manage or cancel in your Apple Account or Google Play subscription settings. The price is shown before you buy, and refunds are handled by Apple or Google under their terms - we cannot issue one directly.

If you cancel, Pro stays active until the end of the period you paid for, then the account returns to the free tier. Nothing in your journal or your Shelf is deleted or locked when that happens.

Disclaimers

Agave & Note is provided "as is", without warranties of any kind. To the fullest extent the law allows, we are not liable for indirect or consequential damages arising from your use of the app, and our total liability is limited to what you paid us in the twelve months before the claim.

Termination

You can stop using Agave & Note whenever you like and delete your account in Profile → Account settings. We may suspend or close accounts that break these terms.

Changes

We may update these terms; the date above reflects the latest version. Material changes will be noted in the app, and continued use after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Maryland and the applicable laws of the United States, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in the state or federal courts in Maryland, and you and we each consent to their jurisdiction. Nothing here removes a consumer-protection right you have under the mandatory law of your own country or state of residence.
